The Texas Religious Freedom & Restoration Act

I will discuss the statute in more detail later in the blog posts, but as a short introduction, the Texas legislature enacted the Texas Religious Freedom & Restoration Act (TRFRA) in 1999 to require the highest scrutiny of legislation which "substantially burdens" the right to free exercise of religion.


Section 110.103 provides the main protections of the statute, stating in pertinent part:


(a) Subject to Subsection (b), a government agency may not substantially burden a person's free exercise of religion.

(b) Subsection (a) does not apply if the government agency demonstrates that the application of the burden to the person:

(1) is in furtherance of a compelling governmental interest; and

(2) is the least restrictive means of furthering that interest.
